ITP: the biggest single cost
The ITP (Impuesto de Transmisiones Patrimoniales) is a regional tax paid by the buyer on the purchase of a resale residential property. In Catalonia the general rate is 10% of the declared purchase price.
Since June 2025, a reduced rate of 5% applies in two specific cases:
- Young buyers: purchasers under 35 years of age with annual income not exceeding 36,000 euros
- Large families: households officially registered as a large family unit (familia numerosa)
The ITP must be submitted to the Agencia Tributaria de Catalunya (ATC) within 30 business days of signing the notary deed. Failure to pay on time results in surcharges and interest.
New-build vs resale: different taxes
If you purchase a new-build property directly from a developer, you do not pay ITP. Instead you pay:
- IVA (VAT): 10% of the purchase price
- AJD (stamp duty): 1.5% of the purchase price in Catalonia
Total tax on a new-build is therefore 11.5% versus 10% for resale. The difference is modest, but it is worth bearing in mind.
Additional costs for foreign buyers
Beyond the standard costs, foreign nationals purchasing property in Spain need to budget for a few additional steps:
- NIE number: All property buyers in Spain, regardless of nationality, must obtain a NIE (Numero de Identificacion de Extranjero). This is a Spanish identification number for foreigners, required for tax purposes. The cost is minimal (around 10 euros at the Consulate or police station) but obtaining it takes time.
- Legal representation: While not legally required, hiring an independent Spanish lawyer (abogado) to review the purchase contract and carry out due diligence is strongly recommended. Legal fees typically range from 1,000 to 2,500 euros.
- Currency conversion: If you are transferring funds from another currency, factor in exchange rate costs and bank transfer fees.
